  Trip Participant Terms and Agreements and Conditions- Exodus Travel Group Spring Break 2015

Participating in spring break Key West 2015(herein known as SBKW ‘12) through Exodus travel group (herein know as Exodus) located at 1655 Reordan ct. suite 2, Key West ,FL,33040 is governed by the following conditions and terms below. Exodus Travel Group LLC is registered in the state of Florida as a seller of travel registration number __ STA38396 ___________.

The trip participant (herein know as traveler, passenger or trip participant) is agreeing that they have read and accept the following terms and conditions and all information pertaining to this trip at www.ExodusTravelGroup/book-now/terms-conditions. If the participant is less than 18 years of age the participant guardian(s) / parent(s) of the trip participant must read and agree and consent, to the terms and conditions. Please print a copy of these terms and conditions for records. Exodus travel group is not responsible or liable for tour participants registering and paying online with the parent(s) / guardian(s) credit card and accepting the terms and conditions on behalf of their parent(s)/ guardian(s) if the trip participants is less than 18 years of age.

PACKAGE PRICE INCLUSIONS

All package inclusions are subject to the following terms and conditions. All packages prices are based on current rates as of 01/19/12. All rates are subject to change in accordance with the final fuel base prices billed by chartered bus lines and changes in government taxes/fees, etc. Any fuel related increases/ and or changes in government taxes or fees will be assessed in no less than 10 day prior to departure and must be paid by all passengers, regardless weather account is paid in full or not.

PAYMENTS,DUE DATES, AND OPTIONS:   In order to register with SBKW  ‘12, Exodus must receive a payment of at least a non-refundable deposit ( $50, $75, $100 or $150 deposits depending on booking).Exodus accepts Visa, MC, AMEX, Discover credit cards via online payments @ www. ________. Deposit due dates differ per school/group. THE FINAL BALANCE PAYMENT DUE DATE for all SBKW ’12 trips is 02/29/2015 unless otherwise stated at the time of booking. All balances owed for your SBKW ’12 trip must be paid by the final balance due date. Final payments received after 02/29/2015 will be subject to a $49 late fee plus any fees imposed by the hotels, bus lines or airlines. All other final balance due dates that were assigned at the time of booking will be subject to this late fee if final payments aren’t received on time. Exodus reserves the right to obtain these fees and payments. You will not be able to travel with Exodus unless the balance is $0. If your final balance is not paid on the final due date you might be subject to cancellation or dropped from trip. A $25 reinstatement fee is applied per person if cancelled after your final balance due date. Refunds of any kind will be received no later than 30 days prior to your departure; some may be received upon return from your trip.

CHANGES IN RESERVATION:  Any changes in your reservation will require written notification and will incur a $30 dollar fee (plus any bus fee). NO CHANGES WILL BE ALLOWED IN LESS THEN 30 DAYS OF YOUR DEPARTURE.  When making changes please include your name, phone number, departure date and departure city, Along with payment for $30. Roommates added to a room will be honored by Exodus with the approval of one or any of the occupants of that room and all of the terms and conditions will apply to all occupants thereafter. For the purpose of the paragraph, adding passengers to an existing reservation will not be considered a change.

CANCELLATION, SUBSTITUTION AND REFUND POLICY:  If you cancel your trip, your right to refund is outlined below. For all cancellations, Exodus will require a request for a cancellation in a written letter mailed by certified mail received more than 60 days prior to your final balance due date listed above. If the cancellation letter is received after the final balance due date, all funds paid are non-refundable. If the letter is received before the cancellation due date, all funds are non-refundable; however funds can be used as a “Future Exodus Trip credit” for up to one year. There are no refunds or credits given after 02/15/12.  They are not permitted to receive “Exodus credit”. Mail all request for cancellation via mail to: Exodus travel group LLC 1655 Reordan ct suite 2, Key West, Fl 33040. All request must be in writing and no refunds will be issued from email and verbal cancellations.  If you can no longer go on the trip you can substitute your reservation by doing a name change. There is a $50 name change fee assessed prior to the final balance due dates. All name change requests made after final balance due date payments are assessed a $50 name change fee plus any additional hotel and bus fees. No name changes will be made less than 45 days prior to the departure unless otherwise authorized by Exodus in writing.  There are no exceptions to our cancellation policy including medical emergencies, procedures, death, or fear of travel of any kind. If you cancel your trip prior to the final balance due date of 02/29/12, you are eligible to receive a “Future Extreme Trip Credit”  in the amount of your total amount of payments minus  $25 transfer fee. The future Exodus trip credit can only be used on a future Exodus Trip and is not valid if cancelling after

02/15/12, regardless of the final balance due date. A Future Exodus trip credit is good for up to one year form the date of cancellation. Future Exodus credits are only able to be used by the trip participant who received the Exodus credit and they are non-transferable to existing Exodus travelers account or another person after the future Exodus trip credit has been redeemed towards a future exodus trip. All unused portions of Exodus trip credits are non-refundable and non-transferable. If the future Exodus trip credit is redeemed for a future trip and the amount of the trip is more than the balance owed for the new trip, the remaining credit amount is forfeited and non-refundable. If the credit is less than the balanced owed for the new trip, you a responsible for the remaining balance.

UNUSED TOUR SERVICES:  No refund will be issued for unused accommodations, bus, transportation, meals, excursions, tour services, including any event and/or if participant leaves SBKW ’12 for any reason.

Hotel Damage Deposit: A 50$-$100 per person refundable hotel damage deposit is required by check-in at some SBKW ’12 locations. This damage deposit is paid right to the hotels and is made by credit card or cash and is subject to change. This is not included in package price of the trip. Each traveler must be prepared to provide this damage deposit upon check- in.  If you should have a problem with your room during SBKW ’12, you must seek remedy with the hotel and not Exodus.  Exodus will not be liable in any way for any damages by you or any other traveler and EXODUS is not responsible for your damage deposit.

ROOMMATE REQUIREMENTS: It is your responsibility to make sure you have the amount of roommates needed for the room occupancy you selected for SBKW ’12. Exodus does not assume responsibility for an additional cost if you do not have enough roommates to fill the room occupancy you selected. Final room list will be completed approximately 60 days prior to each trip date.

FUEL PRICE AND GOVERNMENT TAX INCREASE: Due to the fluctuating price of fuel throughout the world, it is impossible for commercial bus lines or Exodus to predict exact price increase in gas and oil. Exodus does its best to eliminate or decrease any surcharges due to fuel price increase.  In the event that the fuel price does increase by a significant amount, Exodus may authorize a minimal surcharge fee per traveler. Any surcharges due to fuel increase and or government, taxes and fees will be assessed per traveler no later than 10 days prior to departure and must be paid by all passengers prior to travel in order to receive their travel documents and tickets.

MEAL PLAN ( IF APPLICABLE): Exodus provides meal coupons for Exodus meal plans.  Coupons hold no cash value and may be subject to taxes and tip. Trip participant acknowledges that Exodus is not an agent or responsible for any acts, errors, or failures to honor any agreement or other omissions caused by any other restaurants/establishment associated with the meal plan. Meal menu, schedules, and participating restaurants and establishments are subject to change any time.

MERCHANT PRIVACY POLICY: all personal information provided to Exodus will remain private and confidential and not resold to anyone without your express written permission. Exodus uses your contact information to inform you about important trip updates, departure information, and Exodus’s other great trips. If you wish not to be contacted, mailed, text blast or mass emails, please notify via email.

DIGITAL PICTURES AND FILMS: Exodus has the right to photograph and film any participant on SBKW ’12, which we may use for future brochures, advertisement or placed online for promotional use.  Filmmakers/photographers hired by Exodus also have the right to film and photograph any participant on SBKW ’12. Filmmakers/photographers hired by Exodus will own the full rights to their work and may use/distribute their work as they see fit.

DIGITAL PICTURES AND FILMS RELEASE: Whereas, Participant understands that the Participant’s voice, name, and image will be recorded by various mechanical and electrical means of all descriptions (such recordings, any piece thereof, the contents therein and all reproductions thereof, along with the utilization of Participants name, shall be collectively referred to herein as the "Released Subject Matter"),

Participant hereby freely and without restraint consents to and gives unto Exodus and its agents or assigns or anyone authorized by Exodus, (collectively referred to herein as the "Releasees") the unrestrained right in perpetuity to own, utilize, or alter the Released Subject Matter, in any manner the Releasees may see fit and for any purpose whatsoever, all of the foregoing to be without limitation of any kind.  Without limiting the generality of the foregoing, Participant hereby authorizes the Releasees and grant unto them the unrestrained rights to utilize the Released Subject Matter in connection with advertising, publicity, public displays, and exhibitions.  Participant hereby stipulates that the Released Subject Matter is the property of the Releasees to do with as they will.

Participant hereby waives to the fullest extent that Participant may lawfully do so, any causes of action in law or equity Participant may have or may hereafter acquire against the Releasees or any of them for libel, slander, invasion of privacy, copyright or trademark violation, right of publicity, or false light arising out of or in connection with the utilization by the Releasees or another of the Released Subject Matter.

Participant expressly stipulates that the Releasees may utilize the Released Subject Matter or not as they choose in their sole discretion without affecting the validity of this Release.

PROPERTY DAMAGE DISCLAIMER: Any damage caused by an Exodus traveler to any entity of our trips, including bus, hotel or hotel room. vendor properties or any other properties visited during SBKW ’12, will be the sole financial and legal responsibility of that traveler, this includes but is not limited to any fines, fees, legal action or penalties or any damage done by the Exodus traveler. Exodus will promptly remove any traveler(s) off of SBKW ’12 who decide to participate in any damage of property.

RULES, REGULATIONS, AND TRAVELER RESPONSIBILITY:  Exodus and its suppliers reserve the right to enforce reasonable rules and standards of conduct to facilitate the trip for all trip participants’ safety and enjoyment. By agreeing to these terms and conditions, you understand and acknowledge that failure to comply with such rules and standards may result in the trip participant being removed from

the entire SBKW ’12 trip, including but not limited to hotels, airlines, cruises, buses, and/or any EXODUS event at the trip participant’s sole expense, without subsequent refund. If evicted from a hotel, neither Exodus nor the hotel will be responsible for providing other hotel accommodations or refunds. Each trip participant is responsible for his/her own actions throughout the entire trip with Exodus. Each participant can choose to participate or not participate in any activities during the trip. The participant is solely responsible for any and all consequences due to illegal actions taken during this trip. This may also result in the removal from the entire SBKW’12 trip. By agreeing and acknowledging these terms and conditions, trip participant’s and their parent(s)/guardian(s), if applicable, do hereby release Exodus from any and all liability or additional costs arising out of, or in connection with, participant’s removal from the trip.

RELEASE OF LIABILITY:  According to these terms and conditions, the trip participant understands and agrees that Exodus, their employees, affiliates, directors, management, student reps, staff members, and assigns will not assume responsibility for any claims, losses, damages, costs or expenses arising out of injury, accident or death, inconvenience, loss of enjoyment, disappointments, distress or frustration, whether physical or mental, resulting from weather, acts of nature, acts of terrorism, acts of God, delays, cancellation of travel from weather conditions including hurricanes, hotel services, or other factors beyond the control of Exodus.  As lawful consideration for this agreement you agree and covenant that neither you, your family, legal guardian, legal representatives, assigns, heirs, personal representatives, agents, and/or next of kin will not make any claim against Exodus, its owners, its employees, staff, employees acting as staff or sue for bodily injury, emotional trauma, death, or property damage caused in any way as a result of your participation in the trip. You further hereby waive, release and/or discharge all rights you may have in this regard.

Exodus is acting as a travel intermediary between you and suppliers which includes booking and reserving charter bus, cruise line tickets, hotel accommodations, transportation, and/or event accommodations. EXODUS is therefore not responsible for any breach of contracts with suppliers or any acts of negligence by suppliers which would result in any inconvenience, loss, damage, injury, or delay to your during SBKW ’12. EXODUS will not assume liability for any acts of negligence on behalf of their employees, affiliates, directors, management, student reps, staff members, suppliers, ground operators, and assigns, arising from or out of any EXODUS trip, function, or event. In addition, EXODUS does not own or operate any person or entity that provides goods or services for your trip including airlines, cruise lines, hotel accommodations, buses, clubs, food services, and/or any other services and, therefore, cannot be held liable for any acts of negligence by these service providers and suppliers. Without limitation, EXODUS is not responsible or liable for any loss, injury, theft, pilferage, or damage to your luggage, personal effects, or hotel rooms. EXODUS travelers must seek any refunds or compensation directly from the suppliers of the services and not from EXODUS. These services include, but shall not be limited to: Hotels, airlines, cruise lines, buses, clubs, bars, restaurants, or any other service providers or suppliers. EXODUS does not provide, promote, endorse or condone the use of alcohol or drugs and EXODUS is not responsible or liable in any way for the use or abuse of alcohol or drugs by anyone on an EXODUS trip.

ARBITRATION: I AGREE THAT ANY DISPUTE CONCERNING, RELATING, OR REFERRING TO THIS CONTRACT, THE BROCHURE, OR ANY OTHER LITERATURE CONCERNING MY TRIP, OR THE TRIP ITSELF SHALL BE RESOLVED EXCLUSIVELY BY BINDING ARBITRATION IN THE COMMONWEALTH OF FLORIDA, ACCORDING TO THE THEN EXISTING COMMERCIAL RULES OF THE AMERICAN ARBITRATION ASSOCIATION. SUCH PROCEEDINGS WILL BE GOVERNED BY SUBSTANTIVE FLORIDA LAW.

SELLER OF TRAVEL:  Exodus is licensed to sell travel in all applicable states.       FLORIDA
